Human Rights are inalienable rights guaranteed under Part III of the Constitution of India, including the right to life and personal liberty (Article 21), equality before law (Article 14), freedoms under Article 19, protection against arbitrary detention, and the right to fair procedure. These rights are enforceable against the State and its instrumentalities and form the core of constitutional governance and rule of law.
A Human Rights violation arises when State action or inaction, abuse of authority, misuse of criminal or civil process, or institutional failure results in infringement of fundamental rights, dignity, liberty, livelihood, or access to justice. This includes custodial abuse, illegal detention, denial of fair trial, police excesses, discriminatory practices, and systemic failures impacting vulnerable groups.
Nyaya Darpan Foundation undertakes constitutional litigation before the Hon’ble High Courts by invoking writ jurisdiction under Articles 226 and 227. The Foundation files Public Interest Litigations (PILs), writ petitions, habeas corpus petitions, and constitutional challenges to secure enforcement of fundamental rights, judicial oversight, institutional accountability, and structural remedies in cases involving widespread or grave human rights violations.
Any person whose fundamental rights are infringed, or whose liberty, dignity, or legal safeguards are compromised, may approach Nyaya Darpan Foundation. The Foundation also espouses causes of persons unable to approach the courts themselves, including women, senior citizens, prisoners, under-trial accused, falsely implicated individuals, marginalized communities, and advocates facing abuse or misuse of legal processes.
Yes. Nyaya Darpan Foundation adopts a holistic human rights approach, combining litigation with constitutional advocacy, public legal education, policy engagement, stakeholder consultations, and awareness initiatives. These efforts are aimed at preventing violations, strengthening institutional compliance, and fostering a culture of constitutional responsibility. Currently we are supporting only Court Related litigation – Pro Bono / Low Bono and partner with Human Rights organizations and like-minded institutions for awareness campaigns and education.
Civil society members, legal professionals, academicians, journalists, and institutions may collaborate with Nyaya Darpan Foundation through research support, documentation of violations, pro bono litigation, amicus assistance, training programs, and policy advocacy. Such collaborative engagement strengthens access to justice and reinforces constitutional protections at both individual and systemic levels.
